Development
Members of our condominium development practice group represent a number of builders who have developed condominium projects throughout the GTA and surrounding regions; assist clients in obtaining re-zoning and municipal approvals and prepare all condominium documents and agreements required to market and sell condominium units; and work closely with developers and their consulting teams, surveyor, architect and property manager at all stages of the condominium development, marketing and sale.
We regularly act on behalf of developers in preparing all necessary documentation required for the establishment and maintenance of condominium corporations, and we act on behalf of the boards of directors of condominium corporations in matters relating to condominium management.
Governance
This specialized practice group provides advice and services to condominium corporations, board members, unit owners and property managers. Team members represent hundreds of condominium corporations throughout the GTA and surrounding areas, including Barrie and Collingwood. We provide the following services to all types of condominium corporations:
- Interpretation and advice on the new Condominium Act, 1998, and condominium documents
- Declaration, By-laws and Rules review and re-drafting
- Advising and attending at General and Special Owners’ Meetings; including acting as independent chairperson
- Common Expense Lien collection and power of sales
- Enforcement of the Act, Declarations, By-laws and Rules and Mediation/Arbitration proceedings
- Construction Litigation, including construction liens and construction deficiencies
- Drafting and negotiating condominium-related documents (Common Element Alteration Agreements and Reciprocal Agreements)
- Assisting with and conciliating Tarion (ONHWP) claims
- Human Rights complaints and employment matters
- First Year Budget Deficit claims
